Jacqueline Colaitis, age 47, sued Benihana on a wrongful
death theory for the death of her husband Jerry. She claimed
one of Benihana's chefs negligently threw a shrimp at her
46-year-old husband in January 2001. Jerry wrenched his neck
in his efforts to avoid being hit by the shrimp. He developed
neck pain and visited two spinal surgeons who recommended
surgery. He contracted a staph infection and died November 22, 2001 and died.
Benihana's chefs regular flick pieces of shrimp and other items
that they cook in the presence of the guests at the
restaurant who sit around the grills while the chefs cook their
means.
Defendant denied that the chef in question was negligent or that
the flicking of a shrimp toward Mr. Colaitis caused his
death.
