Description:
The State charged Haas by direct information with four counts of first degree sexual assault, alleged to have occurred between January 1, 2004, and June 1, 2008. Haas filed a motion to quash and to dismiss the charges, claiming that the statute of limitations had expired.
Following a hearing, the district court denied Haas' motions to quash and dismiss. In a written order, the district court found that "the statute of limitations likely ha[d] not run on the [317 Neb. 922] counts charged in the Direct Information." The district court stated, however, that a preliminary hearing was necessary to ascertain the ages of the victims to make a final determination on the statute of limitations defense.
