Description:

Negligent hiring - One of defendant's employees shot and killed three employees. In the four years the employee worked for for defendants he was involved fights or altercations every year. After a fight between the employee and two brothers, he was fired. He returned to warehouse armed with aa .38-caliber pistol and 100 rounds of ammunition. He killed three employees, Gerald Allman, Anthony Balogh and Frank Knox, and injured another, Larry Cogdill.

Plaintiff's claimed that defendants were negligent in hiring the employee and in failing to protect those who were killed.

Defendant's denied any negligence.

Outcome:

Plaintiffs' verdict against Union Butterfield in favor of the Knox estate in the amount of $4 million and Dormer Tools to pay the Allman estate for $3.9 million.
