Maxwell Yanof sued the Bridger Ski Foundation on a negligence theory claiming that race officials failed to exercise due care in the management of the race inwhich Yanof was participating when he was hit and injured by an automobile on May 13, 2006 at the intersections of Babcock Street and Fowler Avenues in Bozeman. Yanof sustained broken fingers and other hand injuries that necessitated two surgeries and rehabilitation.

Defendant admitted liability but claimed that Yanof was also at fault.
