Description:

Automobile accident - wrongful death. Husband and father of plaintiffs was killing in an accident near the Chrysler auto plant in Fenton, Missouri. The decedent was one of a number of men who had skipped work and spent 3 or 4 hours in a bar drinking. They were returning to the plant when the driver, Gene Bird, and another passenger, Robert Sitzes, who attempted to grab the steering wheel in an effort to keep the van from running into the median. Plaintiffs' decedent was thrown from the vehicle and his body was then run over by defendant Barr's automobile. The accident occurred at 3:30 a.m. on January 6, 1996. Barr claimed that she did not see the man's body in the roadway and further presented testimony at he was probably already dead when the car ran over the body.

Outcome:

Defendants' verdict finding that decedent was 100% at fault.
