Description:
Medical malpractice - failure to properly diagnose and treat pulmonary embolism with resulting death. Smith, age 38, presented at an emergency room complaining of shortness of breath and coughing. He was examined and diagnosed as having pneuomonitis, he was prescribed antibiotics, and he was sent home. He died of acute pulmonary embolism. Plaintiff claimed that an autopsy showed that the embolism had existed for a number of days. Smith was survived by his wife and a minor son. He was employed as an autobody repairman earning $8,000 a year. Defendant claimed that he had recommended that Smith see a lung specialist.
Outcome:
Jury verdict for plaintiffs for $600,000.00.
