After the work was completed, she sued respondent for poor workmanship, alleging breach of the contract, promissory estoppel, unjust enrichment, negligence, and breach of the covenant of good faith and fair dealing. The district court later dismissed the complaint under Minnesota Rule of Civil Procedure 12.02(e), determining that appellant’s claims are barred by the two-year statute of limitations set forth in Minnesota Statutes section 541.051, subdivision 1(a) (2024), which applies to claims “arising out of the defective and unsafe condition of an improvement to real property.”
