Lancing, Michigan criminal defense lawyer represented Defendant charged with a sex crime and ordered to register as a sex offender.
Pursuant to MCR 7.205(E)(2), in lieu of granting leave to appeal, we VACATE the part of the trial court's order of November 28, 2022, that denied in part defendant's motion to be removed from the sex offender registry, and we REMAND the case to the trial court for reconsideration of defendant's motion. Defendant asked to be removed from the sex offender registry in light of our Supreme Court's decision in People v Betts, 507 Mich. 527, 533; 968 N.W.2d 497 (2021), which held that "the retroactive application of Michigan's Sex Offenders Registration Act (SORA), MCL 28.721 et seq., as amended by 2011 PA 17 and 18 (the 2011 SORA), violates state and federal constitutional prohibitions on ex post facto laws. See U.S. Const, art I, § 10; Const 1963, art 1, § 10." The trial court determined that "[t]he 2011 [a]mendments do not apply to [d]efendant as they are unconstitutional ex post facto laws." But the trial court further ruled that "the SORA requirements that were in place at the time of [d]efendant's criminal act are still applicable to [d]efendant. Therefore, [d]efendant is still required to register as a sex offender under the 1994 version of SORA, MCL 28.723." However, our Supreme Court held in Betts, 507 Mich. at 573, that severance and revival of earlier versions of SORA were not appropriate tools for remedying the constitutional violation. The Betts Court noted concerns about infringing on the Legislature's authority as well as practical concerns related to revival of earlier versions of SORA. Id. at 572-573. Accordingly, the trial court on remand shall reconsider its earlier conclusion that defendant is still required to register as a sex offender under the 1994 version of SORA. The trial court should also take note of this Court's recent decisions in People v Jarrell, __ Mich.App. __, __; __ N.W.2d __ (2022) (Docket No. 356070), lv pending, and People v Lymon, __ Mich. App, __; __N.W.2d (2022) (Docket No. 327355), lv gtd 983 N.W.2d 82 (Mich, 2023).
