Description:

Paul Braley sued Dr. Lawrence Nelson and Eastern Maine Medical Center on medical negligence theories (medical malpractice) claiming that her husband Thomas Braley, age 44, died as a result of substandard care provided to him after he was injured in an ATV accident on May 8, 2009. Thomas Braley suffered broken ribs and internal injuries in the ATV rollover. He was transported to EMMC where Dr. Nelson became his attending physician. Plaintiff claimed that Dr. Neslon negligently failed to properly monitor and treat internal breeding and, as a direct, result her husband's lungs collapsed and she suffered a fatal heart attack.

Defendants' generally denied Plaintiff's claims.

Outcome:

Plaintiff's verdict for $6.7 million including $11,000 in funeral and burial expenses, $1 million for conscious physical pain and suffereing, $1.2 million in loss of consortium damages, and $4.5 million for loss of companionship and emotional distress.
