Description:
Medical malpractice claims by John and Robyn Sprague individually and on behalf of their son Jack who suffered massive brain damage on December 4, 1998 as a result of allegedly being shaken by his baby sitter Nancy Brookbanks, who was subsequently convicted of harming the 11-month-old baby. The Spragues took Jack to the emergency room where he was examined by Dr. Soma Reddy, a pediatrician and Emergency Room doctors Donald Shell and Dr. Hammond J. Dugan. Shell believed that Jack had a concussion and Reddy requested a CAT scan but Dugan believed that Jack was healthy and no test was conducted. The Spragues claimed that had a CAT scan been performed, the doctors would have found that Jack had already suffered a cranial bleed as a result on being a victim of shaken baby syndrome at the hands on Brookbanks on November 18, 1998.
