Description:

David and Mary Zinck individually and on behalf of the Estate of Trista Zinck the parents of Neil Bornstein sued the Gateway Country Store in Newburyport, Massachusetts and William White for killing Trista Zinck, age 16, and severely injuring. White, was intoxicated on beer purchased fraudulently from Gateway by Brendan Kneram in January 2003. Kneram, age 19, and White and two other underage yourg men drank the beer. White was driving the vehicle that hit and killed Zinck and severely injured Bornstein. The plaintiffs claimed that that the Gateway clerk negligently sold the beer to Kneram.

Kneram admitted using a false I.D. to purchase the beer and White was sentenced to 3.5 years in prison for motor vehicle homicide. Gateway denied wrongdoing.

Outcome:
The jury awarded the two Newburyport families $8.6 million in damages including $7 million for the Zinck family with a finding that Gateway was 40% at fault.
