Description:

The son of Kimiyoshi Matsuyama, age 46, brought suit against Dr. Neil S. Birnbaum for medical malpractice claiming that his father died of the stomach cancer that Dr. Birnbaum negligently failed to diagnose for over four years. Matsuyama visited Dr. Birnbaum six times over the treatment period and was repeatedly told to take over-the-counter medications to alleviate the symptoms. Plaintiff claimed that Dr. Birnbaum had a financial incentive not to provide care to his father because of the contract the doctor had with Harvard Pilgrim Health Care Inc. When Dr. Birnbaum finally diagnosed the cause of Mr. Matsuyama's problem, stomach cancer, it has spread over 70 percent of the man's stomach and was inoperable. He died within six months of the diagnosis.

Dr. Birnbaum denied that his care fell below the standard of care.

Outcome:
The jury deliberated two hours last Tuesday and awarded $160,000 for Matsuyama's pain and suffering, and $875,000 for losses suffered by his wife and son.
