William Radley Horsley pleaded guilty to possession with intent to distribute 500 grams or more of a mixture or substance containing methamphetamine in violation of 21 U.S.C. § 841 (a)(1), (b)(1)(A)(viii) and possession of a firearm by a convicted felon in violation of 18 U.S.C. §§ 922(g)(1) and 924(a)(2).

The outcome was: The district court initially imposed a sentence of 180 months’ imprisonment pursuant to a binding plea agreement. That sentence was within the Sentencing Guidelines range applicable to Horsley at the time of sentencing, which spanned 151 to 188 months’ imprisonment. The United States Sentencing Commission subsequently issued amendments to the Guidelines, applicable retroactively, that adjusted the applicable Guidelines range to span 135 to 168 months’ imprisonment. On its own motion, the district court reduced Horsley’s sentence to 168 months’ imprisonment to conform to the new Guidelines range. Horsley now appeals his reduced sentence, arguing that it is procedurally and substantively unreasonable. Affirmed
