Plaintiff has named eight other Defendants, all DCFS workers operating under a Child Welfare Employee License (CWEL). In Count I, Plaintiff states a federal claim, that the DCFS Defendants violated R.R.'s Fourteenth Amendment rights to life, liberty, property, and Equal Protection. Count I is not the subject of the motion to dismiss, as Defendant moves only to dismiss the Count VIII-XXIII state law claims directed against the DCFS Defendants.
Outcome:
The Defendants' Motion for Summary Judgment (D. 189 ) is granted as to Count One and it is dismissed with prejudice; the Court declines to exercise its supplemental jurisdiction over the remaining state law claims which are dismissed without prejudice.
