On February 17, 2006, defendant pled guilty to one count of AUUW (720 ILCS 5/24- 1.6(a)(3)(C) (West 2004)) for possessing a firearm without a Firearm Owners' Identification (FOID) card in exchange for the dismissal of the remaining counts and a sentence of four years' imprisonment. Defendant did not directly appeal his conviction or sentence. On February 6, 2023, defendant filed a petition for relief from judgment under section 2-1401 of the Code. Defendant sought to vacate his conviction, alleging it was unconstitutional based on People v. Aguilar, 2013 IL 112116.
