Description:
Breach of contract - Plaintiff, a potato farmer, entered into a contract with the defendant, a processor, to delivery 12,000 cwt. of potatoes. Price would vary by the quality and conformity of potatoes delivered.



Plaintiff delivered the agreed upon 12,000 cwt. of potatoes, defendant comingled those potatoes with other potatoes delivered over several days.



Defendant later said some potatoes were "rejected" and others accepted during that time period weren't of a high quality and wanted to pay a lower rate.
