Description:

Roger and Glenda McTaggart sued Yamaha on a products liability theory for the personal injuries sustained by Roger, whose left leg was crushed in a low speed rollover incident. Mr. McTaggart was operating the Rhino on a relatively flat, grassy area. During a low speed right turn, the vehicle tipped onto the driver's side, trapping Mr. Taggart's leg under the UTV. He sustained serious and permanent injury to his leg.

The Plaintiffs claimed that the Rhino was defectively designed and that Yamaha was negligent.

The defenses asserted by Yamaha are not available.

Outcome:
