Description:
Tiffany Simmons sued Wal-Mart Stores, Inc. on a negligent hiring theory claiming that Wal-Mart's failure to do a background check on Darius J. Stacy to collect shopping carts at this store in Gainesville exposed her to the risk of being attacked and injured by Darius in December 2006. Tiffany was cut from her ear to the center of her throat by Darius with a box cutter when she asked for help finding a lost cell phone. Plaintiff sought compensation for physical and emotional injuries, continued treatment and damages for pain and suffering.



Wal-Mart denied fault. Wal-Mart claimed that it followed proper procedures in hiring Stacy, having him fill out an application that included questions asking if he had ever been convicted, interviews with managers and a reference check including a call to a McDonald's restaurant where Stacy had been working.
