Shanequa Mimms sued Marianna Toyota, Inc. and Jorge Garcia
on a negligence theory for the injuries and damages that
she sustained as a result of being hit by a car driven
by Garcia on Interstate 10 in 2003. Mimms, age 27, suffered
severe injuries which continue to cause her pain and limit
her activities and enjoyment of life. Mimms and her family were
on their way to Disney World when some luggage fell off of their
SUV. One of the bags contain medical equipment needed by her
son and she sought to retrieve it. Garcia hit Mimms while she
was standing in the median waiting for traffic to clear.
Garcia claimed that he had to veer off of the highway and
onto the median because of a sudden emergency.
