Favronia Fatse, age 74, sued Stew Leonard's in Norwalk, Connecticut on a premises liability theory claiming to have been injured and/or damaged in a fall outside the store while she was a business invitee at the store on March 10, 2007. Plaintiff claimed that as she approached the front door of the store where the shopping carts were kept, she tripped and fell on a defect in the surface that both she and her husband testified was about 3 inches wide and a half in deep. She fractured two bones in her left foot.
Defendant admitted that the condition existed but denied that it was dangerous.
