Description:
Gregg Regan sued Computers Plus Center, et al. on a breach of contract theory. Computers Plus counterclaimed claiming that the State deliberately destroyed her company. In 2001, CPC was awarded a three-year contract for $17.2 million to provide 10,000 Dell computers and 44 servers to various state departments.



The state complained that most of the computers had substandard or missing parts, and that it was overcharged by $50 per computer, or $500,000. The State sued CPC and Kolb on behalf of the state in 2004, seeking treble damages, or $1.75 million.



The defendants claimed that the State had made false claims about CPC and Kolb, and concluded that the state had breached the contract's covenant of good faith and fair dealing.



The defenses asserted by the State in response to Defendants' counterclaim are not available.
