Description:
Gaila Petty suffered brain damage when the 1992 Explorer she was riding in rolled over. The plaintiffs contended that the rear wheel ABS [antilock brake system]inadvertently locked up on the freeway causing the vehicle to swerve into the median. The Explorer rolled over as the vehicle reentered the roadway. The Pettys brought suit against both Kelsey-Hayes and Ford claiming that the ABS system was defective causing the initial loss of control and that the Explorer had an unreasonable tendency to flip over.
Outcome:
Settlement for confidential amount.
