On the day of his death, Mr. Clark ordered liquid feed from Gold Kist. Acoff delivered the feed to Clark's property. After the delivery, Clark asked the driver to pull forward and turn around. Clark then turned and started walking toward the gate. Unfortunately, the driver started backing the truck and did not keep a proper lookout for Mr. Clark.
When Gold Kist purchased the truck in question, it was equipped only with a cab and chassis. Gold Kist installed a hopper to use it as a fertilizer spreader truck. In the spring of 1997, it removed the hopped and added a liquid delivery tank. Both the hopper and the liquid delivery tank obstructed the driver's rear view.
Gold Kist is a member of the National Safety Council, a leading authority on safety. The National Safety Council recommended that such vehicles be equipped with backup horns. Despite the fact that Gold Kist knew about the recommendation and the effectiveness of such horns, it failed to install a horn on the truck in question because it "saw no need to do so."
