Description:
Montgomery, Alabama plaintiff personal injury lawyer represented Plaintiff, who sued on a medical malpractice negligence theory claiming that her baby Jaquarius Smith died shortly after birth because of substandard care provide by the hospital staff.



The child died 14 days after he was born after multiple trips to the hospital from Hirschsprung's Disease which can be cured surgically in most instances.



The elements of a medical malpractice are essentially the same as for any other personal injury case, which are: (1) failure to exercise that degree of care that an ordinary careful doctor who exercise under the same or similar circumstances, (2) damages and/or injures and (3) directly caused by 1 and 2.



The plaintiff has the burden or proving exactly how, in treating the plaintiff, the defendant failed to provide care in line with that standard, and. prove that, as a result of the defendant's provision of sub-standard care, the plaintiff suffered harm that would not otherwise have occurred. Normally the Plaintiff has to establish the elements with a medical expert who practices in the same area as the treating physician.
