Charles P. Stall v. Professional Divers of New Orleans, Inc.

Employment - Past Due Wages - Stall sued Professional Divers for past due wages, attorney fees, and statutory penalties. Stall was hired by PDNO as an offshore diver in 1991. Due to health problems which developed in 1994, he was no longer able to dive and accepted a position in sales with the company. Stall became dissatisfied with his compensation as a salesman and resigned in october, 1996. After resigning he went to the company office to obtain his last paycheck and was told there was a deficit in his account and he would not be paid. Stall filed suit

Trial court found Stall had failed to prove he was entitled to any wages other than $363.00 for some offshore work. The court found that a good faith dispute existed between the parties as to unpaid wages and or commissions and declined to award penalties or attorney fees.
