Description:
Automobile - bus accident - closed head injury to infant. Hawley was a passenger in the rear seat of her mother's automobile which was involved in an accident with defendant's bus which turned left in front of Hawley's mother's car. Hawley was not restrained in the automobile. As a result of the accident, Hawley sustained a closed head injury which has adversely affected her ability to read, write and perform math calculations. Plaintiff claimed frontal lobe injury and a hematome. Defandants claimed that Hawley had pre-existing brain injuries from Shaken Baby Syndrome. Defendant also alleged that Hawley's mother failed to slow or otherwise attempt to avoid the accident.
Outcome:
Jury verdict for plaintiff for $2.8 million.
