During the 1990s, Johnson engaged in a multi-state drug-trafficking enterprise. During the ongoing drug-trafficking enterprise, Johnson was directly responsible for the deaths of two people.1 In one incident, Johnson, Damein Piranti, Rickey Piranti, and another coconspirator shot and killed Bernard Franklin. Sealed J.A. 741. In another incident, Johnson and a coconspirator hired hit man Eldon Brown to kill Richard Villa. Sealed J.A. 741–42. Johnson was ultimately arrested in August 1997 in relation to the drug-trafficking enterprise.
Defendant's sentence was reduced to 790 months in prison.
The Government appealed.
