Description:
Wrongful eviction - conversion - trespass. Prior to November 26, 1996, Mr. and Ms. Alvarado were tenants renting a residence on Brandywine Court in Birmingham, Alabama, from Southbrook, L.L.C. and Engle, Inc. On November 26, 1996, they were evicted from their home. Southbrook owned the residence and Engle, Inc. managed the residence. The plaintiffs alleged that they were wrongfully evicted from their home. She asserted that they had resided in the home for three years. The plaintiff contended that representatives of the defendants entered their residence, removed their belongings, and evicted them from their home. Mr. Alvarado had to spend the night in his car, suffering from frostbite and hypothermia. The plaintiff claimed that, as a result, she suffered past mental anguish. Mrs. Alvarado sued for compensatory and punitive damages. Lost property was $31,000. The defendants denied all allegations and contended that there was a returned check fee owed to them from a bounced check in 1996. They asserted the Alvarados were evicted for not paying the check fee and late charges which totalled $49. Ms. Alvarado los the use of the home and all of her possessions.

Verdict for plaintiff for $11,000.00.
