Description:

Breach of contract, bad faith bread of an insurance contract, assault, battery, willful and wanton negligence, intentional infliction of emotional distress and outrageous conduct - Both female plaintiffs were insured by Farmers Insurance Exchange (defendant) and in separate automobile accidents a year apart. Male plaintiff was husband of one of the female plaintiffs who claimed loss of consortium deriving from the incident.

First plaintiff to be assaulted clearly informed defendants of her mistreatment by the chiropractor.

Farmers Insurance referred both plaintiffs to see a chiropractor to determine whether benefits should be paid.

The chiropractor allegedly sexually assaulted both women in separate incidents and then sent in a recommendation that resulted in a denial of benefits.

Outcome:

For defendant for the first incident and against defendant on second incident (chiropractor settled).
