Western was involved in nationwide unfair claims practices. The conduct
involved the requirement of original receipts or other documentary
evidence regarding burglary claims even where there was no reason to doubt
the statement of the claimant that the property was indeed lost. Plaintiff
asserted that Defendant's conduct violated the Unfair Claims Practices Act
which requires all insurance companies to pay claimes when liability
becomes "reasonably clear." Plaintiff asserted that there was no reason to
disbelieve her claim and it should have been paid.
