Description:
Premises Liability - Trip and Fall. Plaintiff, Lola Chamberlain, fell and broke her jaw and injured her neck and back when she stumbled over a cement block left in the doorway of a Wal-Mart Store in January, 1994 in Aurora, Colorado. Chamberlain claimed that Wal-Mart's employees used the block to prop open a door at the superstore. Chamberlain claimed that she did not see the block because the area was poorly lit and she was carrying her grandchild. She underwent three surgeries and has to use a machine every night that continuously opens and closes her mouth to prevent the development of scar tissue. Her neck injury resulted in a cervical fusion and a permanently stiff neck.


Wal-Mart claimed that the block was an open and obvious hazard. Wal-Mart took surveillance videos of Mrs. Chamberlain in an effort to challenge her damage claim but they proved to be more valuable to plaintiff.

Outcome:
The jury found that Chamberlain had sustained a total of $519,000 in damages but also found that she was 30% at fault.
