"The Fair Labor Standards Act (FLSA) is a federal law that sets minimum wage and overtime pay standards for most employees in the United States. The FLSA also prohibits child labor and requires employers to keep certain records.
Employers who violate the FLSA may be subject to a variety of penalties, including civil fines, liquidated damages, and back wages. Employees may also file lawsuits against employers who violate the FLSA.
Here are some examples of FLSA violations:
Paying an employee less than the minimum wage.
Failing to pay an employee overtime for hours worked over 40 in a week.
Misclassifying an employee as exempt from overtime pay.
Requiring an employee to work off the clock.
Failing to keep accurate records of an employee's hours worked and wages earned.
If you believe that your employer has violated the FLSA, you should contact the Wage and Hour Division of the U.S. Department of Labor. You can also file a lawsuit against your employer in federal court.
Here are some tips for employees who believe that their employer has violated the FLSA:
Keep a record of all hours worked and wages earned.
Keep a copy of your employment contract, if you have one.
Keep a copy of your paystubs.
Document any conversations with your employer about your wages or hours worked.
If you believe that you have been retaliated against for reporting an FLSA violation, keep a record of the retaliation.
