Description:

Greenbelt, Maryland Fair Labor Standards Act violation employment law lawyer represented the Plaintiff.

The Fair Labor Standards Act (FLSA) is a US law that protects workers from unfair pay practices. The FLSA prohibits certain actions that violate its labor standards, including:

Minimum wage: Employers must pay covered employees at least the federal minimum wage

Overtime pay: Employers must pay covered employees overtime at a rate of one-and-one-half times their regular pay

Child labor: Children under 16 cannot work more than certain hours, and children under 18 cannot work in certain jobs

Accurate records: Employers must keep accurate records of employee hours

The FLSA also prohibits the sale of goods produced in violation of the law. The Wage and Hour Division of the Department of Labor (DOL) can restrain the shipment of goods that violate the FLSA.

The DOL enforces the FLSA through administrative procedures, litigation, and criminal prosecution. The DOL can recover back wages and liquidated damages for employees who have been underpaid or have had their overtime violated. Employers who willfully violate the FLSA may face criminal penalties, including fines and imprisonment.

The FLSA applies to employers with annual sales of $500,000 or more, or who are involved in interstate commerce.
