The Employee Retirement Income Security Act (ERISA) is a federal law that regulates employee benefits, such as retirement, health care, disability, accident, and death benefits. ERISA sets minimum standards for private sector plans, and protects individuals in those plans.
Here are some of the key provisions of ERISA:
Plan information: Plans must provide participants with information about funding, coverage, and other plan features.
Fiduciary responsibilities: Fiduciaries, or those who manage plan assets, have a responsibility to act in the best interests of plan participants. They can be held personally liable if they misuse plan assets or don't fulfill their fiduciary duties.
Grievance and appeals process: Plans must establish a process for participants to appeal benefit denials.
Right to sue: Participants can sue for benefits or breaches of fiduciary duty.
Pension Benefit Guaranty Corporation (PBGC): If a defined benefit plan is terminated and underfunded, the PBGC, a federally chartered corporation, guarantees payment of certain benefits.
COBRA: The COBRA Amendment allows some workers and their families to continue their group health plan for a limited time after job loss.
