On September 12, 2023, Kausland and Volek entered into an agreement in
contemplation of marriage (Agreement) to address their property rights. The
Agreement provides as follows:

The parties hereby agree that should CHRISTOPHER MARK VOLEK
file for divorce within two years of the date of matrimony that
JULIANNE KAUSLAND will be entitled to a one-time payment only
of $50,000. The parties further agree that should either party file
divorce after two years from the date of matrimony, that JULIANNE
KAUSLAND will be entitled to a one-time payment only of $20,000.
The parties further agree that should JULIANNE KAUSLAND in any
way challenge any aspect of this agreement including the validity or
enforceability of any provision in court or in any legal proceeding, she
will forfeit any and all payment(s) described herein.
Kausland and Volek married on September 20, 2023. On November 13, 2024,
Volek filed for divorce. On December 6, 2024, Kausland filed her Motion for
Temporary Orders, and on March 11, 2025, she filed her Original Answer and
Counter-Petition for Divorce and Suit to Enforce Premarital Agreement. Both parties
filed motions for partial summary judgment. On May 22, the trial court granted
Volek’s motion and denied Kausland’s. The Final Divorce Decree incorporated the
trial Court’s summary judgment rulings.
