Plaintiff alleged that Cabot police officer Matthew Fitzhugh used excessive force to detain and arrest him without legal justification in the parking lot of a Walmart store. Scruggs was working as a ballot signature gatherer and was not suspected of any criminal activity. Despite Scruggs cooperating and offering to leave, Fitzhugh demanded his identification, grabbed him, and used a taser to subdue him when no reasonable suspicion of a crime existed. Scruggs was charged with resisting arrest but the charges were later dropped. The complaint alleges Fitzhugh violated Scruggs' 4th Amendment rights and asserts a claim against Fitzhugh in his individual capacity for excessive force.
