Elise C Rodgers, individually and as Mother and Natural Guardian of Kylie Rodgers, a Minor, and Matthew J Larson sued Affiliated Community Medical Centers, PA; City of Willmar d/b/a Rice Memorial Hospital, and Dr. Gabrielle A. Vencel Olson on medical negligence (medical malpractice) theories claiming that substandard care during the labor and delivery process in 2007 left her with multiple health problems including spastic quadriplegic cerebal palsy, cortical impairment, neurological difficulties and seizures.

The defenses asserted by Defendants are not available.

Plaintiffs' verdict for $23.2 million.

Winning a brain damaged baby case is always a major victory for the lawyer and for the client because the lawyer has typically risked a lot of his or her own resources and the client typically desperately needs the money to care for the child. Without the insurance company money that will be paid at the end of the appellate process, assuming the verdict and judgment is affirmed, the child would be dependent upon the state for the rest of his or her life.
