The Court adopts Judge Russo's reasoning and conclusion as to Plaintiff's declaratory relief and breach-of-contract claims. The Court adopts Judge Russo's conclusion regarding Plaintiff's negligence per se claim, but grants summary judgment for the reasons stated herein.
