"The Fair Labor Standards Act (FLSA) is a federal law that establishes minimum wage, overtime pay, recordkeeping, and youth employment standards for full-time and part-time workers in the private sector and in Federal, State, and local governments.
Minimum Wage
The federal minimum wage is $7.25 per hour. However, many states and localities also have minimum wage laws that are higher than the federal minimum wage. In cases where an employee is subject to both state and federal minimum wage laws, the employee is entitled to the higher minimum wage.
Overtime Pay
Nonexempt employees covered by the FLSA must be paid overtime pay at a rate of not less than one and one-half times their regular rate of pay for hours worked over 40 in a workweek. A workweek is defined as any fixed and regularly recurring period of 168 hours (seven consecutive 24-hour periods).
Recordkeeping
Employers are required to keep certain records about their employees' hours worked and wages paid. These records must be kept for at least three years.
Youth Employment
The FLSA also sets standards for the employment of minors. For example, minors under the age of 16 cannot work in certain hazardous occupations. Additionally, there are restrictions on the number of hours that minors can work.
Enforcement
The FLSA is enforced by the Wage and Hour Division of the U.S. Department of Labor. Employees who believe that their rights under the FLSA have been violated can file a complaint with the Wage and Hour Division.
