Date: 06-13-2025

Case Number: 25-cv-00581

Judge: Alan D. Albright

Court: United States District Court for the Western District of Texas (Travis County)

Plaintiff's Attorney: Nicholas Thompson and Marc Zito

Defendant's Attorney: Brayan Neal and Stephen F. Fink

Description:
Austin, Texas civil rights lawyers represented the Plaintiff on an Americans with Disabilities Act theory.

The Americans with Disabilities Act (ADA) is a US civil rights law that prohibits discrimination based on disability. It ensures equal opportunities for individuals with disabilities in various aspects of public life, including employment, state and local government services, public accommodations, and transportation. The ADA aims to provide people with disabilities the same opportunities as everyone else to participate in mainstream society.

Key Aspects of the ADA:

Employment:

.

The ADA prohibits discrimination in hiring, firing, promotion, and other employment practices. Employers must also provide reasonable accommodations to qualified individuals with disabilities, allowing them to perform the essential functions of their jobs.

Public Services:

.

State and local governments must ensure their services, programs, and activities are accessible to people with disabilities. This includes making physical spaces accessible and providing reasonable accommodations to ensure effective communication.

Public Accommodations:

.

The ADA requires places of public accommodation, such as restaurants, hotels, and retail stores, to be accessible to individuals with disabilities. This includes removing architectural barriers where readily achievable and providing reasonable modifications to policies and practices.

Transportation:

.

The ADA mandates accessible public transportation, including buses, trains, and subways. It also requires accessible paratransit services for individuals who cannot use the regular public transportation system.

Telecommunications:

.

The ADA ensures that people with hearing or speech impairments can communicate over the telephone through telecommunication relay services.

Amendments to the ADA:

In 2008, the Americans with Disabilities Act Amendments Act (ADAAA) was passed.

The ADAAA broadened the definition of "disability" to include a wider range of impairments.

It clarified that mitigating measures, such as medication or assistive devices, should not be considered when determining if an individual has a disability.

The ADAAA also emphasized that an impairment that substantially limits one major life activity is considered a disability, even if it does not substantially limit other major life activities
