Palacios Castorena has a lengthy criminal history while in the United States. In 2010, he was convicted of drug conspiracy in the Northern District of Oklahoma and ordered to serve 30 months imprisonment. In 2012, Palacios Castorena was convicted again for drug conspiracy and unlawful reentry in the Western District of Texas. He was ordered to serve 45 months' imprisonment. In July 2025, state court records show that Palacios Castorena pleaded guilty to domestic abuse in the presence of a minor. He was sentenced to a one-year suspended sentence, which was later revoked after being arrested and charged with stealing a vehicle in state court. During the booking process, law enforcement discovered that Palacios Castorena is not lawfully in the United States. Records show that he was removed from the United States in 2011, 2012, and 2015.

Palacios Castorena will remain in custody pending transfer to the U.S. Bureau of Prisons and is expected to face removal proceedings following the sentence.

Homeland Security Investigations investigated the case. Assistant U.S. Attorney Michele Hulgaard prosecuted the case.
