The Plaintiffs filed a complaint alleging that Defendant violated the overtime wage provisions of the FLSA, PMWA, and WPCL, and violated unpaid straight-time wages under Pennsylvania common law; conducted necessary discovery to obtain payroll and timekeeping records and data, as well as data related to Defendant's company policies and computer login processes; developed a class-wide damages model, engaged in settlement discussions with the assistance of the Honorable Thomas J. Rueter; and briefed a joint motion for approval of the Settlement. These actions resulted in an understanding of the strengths and weaknesses of the claims and the Defendant's potential defenses, enabling counsel to make an informed decision that the Settlement Agreement is fair, adequate, reasonable, and in the best interests of the settlement class.
