Description:
Des Moines, Iowa personal injury lawyer represented the Plaintiff who sued the Defendant on a 42 U.S.C. 1983 deliberate indifference theory.

Inmate Travis Dantzler brought suit under 42 U.S.C. § 1983 alleging, inter alia, that Dr. Tonia Baldwin, a physician at the Clarinda Correctional Facility (CCF), was deliberately indifferent to his complaints of knee pain by delaying an MRI and orthopedic referral based on his parole eligibility—a nonmedical reason. Dr. Baldwin moved for summary judgment based on qualified immunity. She argued that she was not deliberately indifferent to Dantzler's serious medical needs. Alternatively, she asserted that the law was not clearly established "because no reasonable medical professional would have believed that her treatment of [Dantzler] would amount to a constitutional violation.
