United States of America v. Andre Michael Dubois

The Supreme Court requires appeallate courts to decide whether United States v. Rahimi, 144 S. Ct. 1889 (2024),

abrogated our decision in United States v. Rozier, 598 F.3d 768, 770–71 (11th Cir. 2010), upholding the federal law that bars felons from possessing firearms and ammunition, see 18 U.S.C. § 922(g)(1). Following supplemental briefing, we conclude that Rahimi—like New York State Rif le & Pistol Ass'n v. Bruen, 142 S. Ct. 2111 (2022)—did not abrogate our holding in Rozier that section 922(g)(1) is constitutional under the Second Amendment.



In 2018, Andre Dubois entered an Express Copy Print & Ship store in Suwanee, Georgia, and attempted to ship a box containing firearms to the Commonwealth of Dominica. Federal officials seized the shipment and charged Dubois with three counts: attempting to smuggle firearms out of the United States, see 18 U.S.C. § 554; delivering firearms to a common carrier for shipment without written notice, see id. § 922(e); and possessing a firearm as a felon, see id. § 922(g)(1)

Defendant was found guilty.
