The Fair Debt Collection Practices Act (FDCPA) is a federal law that prohibits debt collectors from using unfair, deceptive, or abusive practices to collect consumer debts. The FDCPA went into effect in March 1978.

Here are some of the things the FDCPA prohibits:



Contacting debtors at odd hours

Repeatedly calling debtors on the phone

Threatening legal action that isn't actually planned

Telling others about a debtor's debts



Lying to debtors



Making debtors pay more than they owe

Threatening debtors with arrest, jail time, property liens, or wage garnishment



The FDCPA applies to debts incurred for personal, family, or household purposes, but not to business debts. It also doesn't generally apply to the original creditor or business the debt was owed to.

Debtors can request to stop debt collectors from calling their home phones by sending a letter to the debt collector. It's a good idea to send the letter by certified mail with a return receipt.
