Ashley Curtis v. Nissan Motor Acceptance Company
Date: 08-29-2023
Case Number: 2:23-cv-00180
Judge: Ted Stewart
Court: United States District Court for the District of Utah (Salt Lake County)
Plaintiff's Attorney: Matt Bagley
Defendant's Attorney: Branden Kartchner and Jason Baker
"The Fair Credit Reporting Act (FCRA) is a federal law that protects the privacy and accuracy of your credit report. It also gives you the right to dispute inaccurate information and to get free copies of your credit report from each of the three major credit bureaus once a year.
The FCRA applies to all consumer reporting agencies, which are businesses that collect and sell information about your credit history, including your payment history, bankruptcies, and other financial information.
The FCRA gives you the following rights:
The right to a free copy of your credit report from each of the three major credit bureaus once a year. You can request your free report at annualcreditreport.com.
The right to dispute any inaccurate information in your credit report. If you find inaccurate information, you can file a dispute with the credit bureau. The credit bureau must investigate your dispute and remove the inaccurate information if it is found to be inaccurate.
The right to know who has accessed your credit report. You can get a copy of your credit report disclosure, which will show you who has accessed your report in the past year.
The right to limit who can access your credit report. You can place a security freeze on your credit report, which will prevent most businesses from accessing your report without your permission.
If you believe that your rights under the FCRA have been violated, you can file a complaint with the Consumer Financial Protection Bureau (CFPB).
Here are some additional things to keep in mind about the FCRA:
The FCRA does not apply to all types of information. For example, it does not apply to information about your employment history or your rental history.
The FCRA does not prevent creditors from denying you credit based on your credit report. However, it does require creditors to give you a copy of your credit report and to explain why they denied you credit.
The FCRA is a complex law. If you have any questions about your rights under the FCRA, you should consult with an attorney."
