The Employee Retirement Income Security Act (ERISA) is a federal law that protects the retirement assets of American workers and sets minimum standards for certain employer-sponsored plans:



Retirement plans



ERISA requires plans to provide participants with information about the plan, including funding and features. It also sets standards for vesting, benefit accrual, and funding.



Health plans



ERISA prevents states from directly regulating employer-sponsored health plans.

Fiduciaries



ERISA establishes standards of conduct for those who manage plan assets. It also prohibits fiduciaries from misusing plan assets.



Beneficiaries



ERISA requires plans to disclose financial information to beneficiaries. It also guarantees payment of certain benefits to beneficiaries through the Pension Benefit Guaranty Corporation (PBGC) if a defined benefit plan is terminated.

Enforcement



ERISA is enforced by the Employee Benefits Security Administration (EBSA), a unit of the U.S. Department of Labor (DOL).
