"Pennsylvania follows a modified comparative negligence rule, which means that you can recover damages if you are less than 50% at fault for an accident. If you are found to be more than 50% at fault, you will not be able to recover any damages.



The court will assign percentages of fault to each party involved in the accident. The plaintiff's recovery will be reduced by the percentage of fault that is attributed to them. For example, if the plaintiff is found to be 20% at fault and the defendant is found to be 80% at fault, the plaintiff will only be able to recover 80% of their damages.
