Duty of Care:
In West Virginia, drivers have a duty of care to operate their vehicles safely and avoid causing harm to others. This means following traffic laws, driving at a reasonable speed, and being aware of your surroundings.
Negligence:
If a driver breaches their duty of care and causes an accident, they may be considered negligent. To prove negligence, the injured party must show that:
The driver owed them a duty of care.
The driver breached that duty of care.
The breach of duty caused the accident.
The accident caused the injured party damages.
Comparative Negligence:
West Virginia follows a modified comparative negligence law. This means that even if the injured party is partially at fault for the accident, they may still recover damages from the other driver, as long as they are less than 50% at fault. The amount of damages the injured party can recover will be reduced by their percentage of fault.
For example, if the injured party is 20% at fault for the accident and their damages are $100,000, they would be able to recover $80,000 from the other driver.
