United States of America v. Heather D. Obrad

Clarksburg, West Virginia sexual abuse of an adult was in custody charge criminal defense lawyer represented Defendant, Heather D. Obrad, a correctional employee at Federal Corrections Institution Hazelton, was charged with having inappropriate contact with an inmate.



Obrad, of Granville, West Virginia, pleaded guilty to one count of "Abusive Sexual Contact.” Obrad, 27, a secretary at FCI Hazelton, admitted to having sexual contact with an inmate at the facility from August to October 2020.



Obrad is facing up to two years of incarceration and a fine of up to $250,000. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.



Assistant U.S. Attorney Christopher L. Bauer is prosecuting the case on behalf of the government. The Office of Inspector General investigated.



18 U.S.C. 2243 (b) EXUAL ABUSE OF AN ADULT WARD IN CUSTODY



(b) Of a Ward.—Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly engages in a sexual act with another person who is—

(1) in official detention; and

(2) under the custodial, supervisory, or disciplinary authority of the person so engaging;

or attempts to do so, shall be fined under this title, imprisoned not more than 15 years, or both.
